These Terms of Use ("Terms") govern your use of the website jewelcheckapp.com (the "Site") and describe how the Site relates to the iOS application Jewelry Identifier: JewelCheck (the "App"). Both are operated by İsmail Kurt ("we", "us", "our"). By using the Site you agree to these Terms.
1. The Site and the App
The Site provides information about the App and links to download it from the Apple App Store. Your use of the App itself is governed by Apple's Licensed Application End User License Agreement, and by our Privacy Policy.
2. Informational nature of results
JewelCheck uses artificial intelligence to analyze photographs of jewelry and to provide identification insights, including likely materials, gemstones, styles and estimated value ranges. These results are generated automatically from what is visible in an image. They are provided for informational purposes only and are not a professional appraisal, gemological certification, valuation, or advice of any kind. Do not rely on them for insurance, purchase, sale, tax, legal or investment decisions without independent verification by a qualified professional.
3. Subscriptions
The App is free to download. Optional premium features are offered as auto-renewing subscriptions purchased through Apple. Pricing, billing, renewal and cancellation are handled by Apple under the App Store terms and your Apple ID settings. We do not process payments and cannot issue refunds directly; refund requests are made through Apple.
4. Acceptable use
You agree not to use the Site or the App to upload content you do not have the right to use, to attempt to interfere with, disrupt or reverse engineer the Site or the App, to scrape or bulk-download the Site, or for any unlawful purpose.
5. Intellectual property
The Site, the App and their content, including text, design, logos and software, are owned by us or our licensors and are protected by copyright and other laws. You may not copy, modify or redistribute them without permission. Apple, the Apple logo, iPhone and App Store are trademarks of Apple Inc. JewelCheck is not affiliated with or endorsed by Apple Inc.
6. Third-party links and services
The Site links to third-party sites and services, including the Apple App Store. We are not responsible for their content, availability or practices.
7. Disclaimer of warranties
The Site and the App are provided "as is" and "as available" without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose and non-infringement. We do not warrant that identification results will be accurate, complete or current.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential or special damages, or for any loss arising from reliance on identification results, from purchases or sales made on the basis of such results, or from use of or inability to use the Site or the App. Our total liability for any claim relating to the Site shall not exceed the amount you paid us, if any, in the twelve months before the claim.
9. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above shows the current version. Continued use of the Site after changes means you accept the updated Terms.
10. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles.
